Federal Judge Rules Lawfully Exercising Right = Nullification of 4th Amendment

While taking a walk one day,  legally open carrying a firearm, Christopher Proescher was stopped by police, questioned and arrested.  The local prosecutor, seeing the Mr. Proeshcer committed no crime dropped all charges.  In response to the false arrest Proescher reasonably filed a lawsuit against the officers. Fast forward to Federal judge William S. Duffey Jr. who made the inane decision that while the arresting officers were wrong in arresting Proescher (you know, because he didn’t break any laws) that carrying a pistol openly constitutes reasonable suspicion of a crime, which authorizes officers to detain the person who is carrying and as such the officers acted properly. Allow me to rephrase: By exercising your legal right, you have forfeited your 4th Amendment Rights and as such will be subject to detention and false arrest with no recourse. Did the TSA have it coming? LAX, an inevitability?

When I ask if the TSA had it coming, i’m not referring to the TSA official, Geraldo Hernandez, who lost his life in Los Angeles at the hands of alleged shooter Paul Ciancia, but rather did the way the TSA as an organization harass, molest, humiliate and intimidate people over the last decade lead to this as an inevitability. Are the TSA and it’s agents little more than the bullies we find in situations like Taft Union High Schol and New Bedford Massachusetts? Situations where those being bullied and picked on eventually were driven to crazed acts with terrible consequences. I’m not condoning their actions, but I see public service announcements every day decrying the evils of bullying and how people should not tolerate it.  I shake my head because, just like real life, telling someone usually just makes it worse. St. Gabriel Possenti – Patron Saint of Gun Owners

There seems to be patron saints of nearly everything.  Last year I discovered a Saint that surprised even me. Today, being All Saint’s Day, I thought I would take a moment to bring to light the story of that particular Saint;  Saint Gabriel Possenti, the Patron Saint of Handgunners. In 1860, Saint Possenti was attending seminary in the mountain village of Isola.  He was also dying of tuberculosis which would eventually take his life less than two years later. When a group of 20 armed marauding bandits, from Garibaldi’s army, came to the village to pillage and rape, the villagers hid the best they could and hoped that the terror would pass them by. Think of them as your standard gun control advocates who prefer to hide and hope that someone else will protect them. Sanford, FL knee-jerks guns out of the hands of volunteers

When political knee jerk reaction meets the void where common sense has been sucked out you apparently get Sanford Florida. In the city where Neighborhood Watch member George Zimmerman saved his own life by stopping a man who was beating him to death, Sanford will release new parameters at a community meeting on November 5, stating explicitly that residents acting under the “authority” of the neighborhood watch may not carry a firearm or pursue someone they deem suspicious. I can understand the second part of this directive.  Members of the neighborhood watch may not be trained in surveillance and their pursuit might put them in a dangerous position, such as when George Zimmerman was attacked and almost murdered by the suspicious person he was following who doubled back and tried to beat him to death. Gun Control Sandy Hooker Claims Victim Would Rather Die Than Carry A Gun

A rather amazing thing has been going on in the schools since the Sandy Hook tragedy last year; common sense seems to be gaining a foothold.  School boards and districts are finally realizing the danger of believing in so called “gun free zones”.  With this realization comes the next step: action.  In many places across the country that action is the revocation of the bans denying teachers their constitutional right to keep and bear arms. I wrote yesterday that this isn’t just in Texas or deeply red states but in places like St. Helens Oregon. You can go ahead and add Briggsdale Colorado to the growing list as well. School administrators in the tiny Colorado town of Briggsdale will allow an unspecified number of teachers to carry concealed handguns in the classroom as long as they agree to participate in ongoing training. St. Helens School District erupts with common sense; Lifts ban on armed teachers

The St. Helens School Board in Oregon lifted a ban that had prevented teachers with concealed carry permits from carrying their guns on campus. School board chairman Marshall Porter said, “The current law in Oregon allows for anyone to concealed carry on school grounds. To exclude our staff seems like they’re being punished. They should have a right to protect themselves if they choose.” According to ABC News, the decision impacts seven schools within the St. Helens School District. TSA to use gun permit system to single out gun owning flyers

The Transportation Security Administration is expanding its screening of passengers before they arrive at the airport by searching a wide array of government and private databases that can include records like car registrations and employment information. What else does it include?  Well, if you are a gun owner with a CCW permit, it includes that.  If you live in a state that requires you to register a firearm, it includes that.  If you live in a state that keeps a database of firearm purchases, it includes that. Why is that a big deal? Because instead of looking for terrorists, the TSA will be directing extra scrutiny at law abiding gun owners while the guy from Nigeria with a pound of C-4 in his underwear will be waved by since the TSA is more comfortable with planes being hijacked than being accused of racial profiling.
