Another WTF moment from the ATF

There is a trial going on in the Supreme Court that isn’t getting too much press but if nothing else it highlights the pointlessness of gun control and the ATF in general. Abramski v United States The facts of the case are pretty straight forward.  A Law Enforcement Officer from Virginia goes to a gun shop and buys a gun.  He then takes the gun to a Pennsylvania FFL Dealer and transfers it over to his uncle for whom the gun was for.  The officer, Mr. Abramski, picked up the gun as a gift for his uncle and followed the law about transferring ownership to a resident of another state, hence the FFL transfer and the NICS check.  The uncle had given his nephew money to purchase the gun but the act of picking it up and driving it to him was viewed by Mr. Abramski as a gift....

I guess “innocent” is technically not true but what was not a crime a week ago is one now, as Tyrone Watson found out. The 30 year old Bridgeport man is the first person to be charged in Connecticutt for having a “high capacity magazine”. Or, rather, for having the magazine that came with his handgun known by most rational people as a normal magazine.  But this is what happens when gun controllers get to arbitrarily dictate what is “high capacity” and define what is “normal”. Few pistols now a day hold less than 11 rounds, the noticeable exception being the 1911 and its clones.  But Glocks for instance, favored by law enforcement departments around the country hold 15 rounds standard.  Springfield Armories popular XD line hold 13 rounds for the .45 (also standard) and even more for the smaller caliber rounds.  The Baretta 9mm holds 15 rounds as...

Cautionary tale gun owners can take from Jameis Winston

In case you aren’t that into sports allow me to rehash the tale of Jameis Winston.  Winston is currently the quarterback for the FSU Seminoles, the #1 college football team in America and the presumptive Heisman Trophy winner. A look at the media, especially the ones with heavy liberal bias like MSNBC, the Washington Post and NPR Radio, one would think that blood runs in the street and everyone is walking around with machine guns and that were purchased at “evil” gun shows.  Not only do media outlets sensationalize and overplay gun crime they do something even more disingenuous by hardly ever covering the many times when guns save lives. I used to think that this was solely an anti-gun mindset that the liberal media held and therefore would only cover stories that made guns and gun owners look bad.  But that is only half the tale.  It’s not just about guns, but rather the media only covers stories that fit into their chosen narrative. Gun Owner’s Property Stolen By Police Returned After Federal Lawsuit Settled

In a case rife with police corruption and officers acting with vindictive immorality, the city of Cleveland faced losing BIG in a 5th Amendment case brought by Derrick Washington who had his property stolen by police. The case stemmed back to an incident in the morning of February 10th, 2013.  Washington called the police at 2:09 in the morning to report a shooting in the 2800 block of East 116th Street.  When officers arrived on scene Washington informed them that he had a valid concealed carry permit and that his firearm was in his car. In lieu of doing any real police work that might involve looking for the actual shooter, the police officers involved at this point decided to arrest Washington.  The report they filed reported that he told them that he had been drinking.  Washington was arrested and charged with using weapons while intoxicated and illegally carrying a concealed...

Death of the Fourth Amendment means danger to the Second

You will often hear me voice my disdain for violations of the Fourth Amendment, freedom from unreasonable search and seizures, as I believe that it is second only to the Second Amendment with regards to importance rights enumerated by the Constitution.  While the other rights are important, the 4th is supposed to protect us from warrantless midnight raids of secret police and from our person being molested by thugs on fishing trips hiding behind badges. Gun Hating Principal Bans Mother From School For Having A CCW Permit

Janina Dallas, the principal of McBean Elementary School in Hephzibah, GA,  has involved the police department in banning a student’s mother from the buildings and school property. The mother banned is Tanya Mount.  What did Tanya do that was so dangerous that it warranted Dallas taking these extreme measures? Mount took a picture of her recently issued Georgia CCW and posted it on facebook.   While I wouldn’t have posted my carry permit or any form of ID on social media there is no crime in that.  And if Mount was excited by getting hers and wanted to show her friends then I do not see the harm. Yet, Mount, an Army veteran, soon would discover what harm an irrational, hoplophobic administrator on a power trip can cause. Playing with toy guns AT HOME gets 3 students yearlong suspension from school

From Political Outcast: The Virginia Beach City Public School district is saying that the students aren’t actually being expelled; they’re being given “long-term suspensions.” Whatever the case, the students won’t be allowed back to school for the rest of this semester and even until June of next year. There will be some hearing in January to decide if these students deserve longer-term suspensions. These “suspensions” were prompted by an incident a couple weeks ago when a few friends were playing with their airsoft plastic pellet guns in one of the boys’ front yards while they were waiting for the morning bus to come. A “concerned” neighbor called 911, even admitting to the operator that the guns were toys, but that they made her feel “uncomfortable.” Local news media reported that ironically, this concerned neighbor’s own son was among those kids playing in an airsoft gun war. Between the years of 1692 and 1693 more than 25 people were accused  of being witches and were either executed or died in prison in the area around Salem Massachusetts.   Nearly all of the accused and condemned had little more evidence against them than some other person pointing at them and yelling “WITCH!!” One might think that some 300 plus years down the line we might have evolved over such knee jerk reactions and rushes to judgment but when it comes to gun owners that is often not the case.  In particular, a person can request a protective order in many states by simply saying they were threatened.  No proof is needed, no evidence required.  Yet for a falsely accused gun owner they are completely stripped of their 2nd Amendment rights, as a condition of a protective order is that you must forfeit your firearms for the duration...

Brian Aitken: In NJ, even when you are innocent you’ll pay like you’re guilty

Brian Aitken had his life destroyed for doing something that all Americans are constitutionally guaranteed the right to do, owning a firearm. While moving to the draconian, gun-hating state of New Jersey, Brian was pulled over while transporting his gun to his new home. Guns are all but banned in New Jersey, save for under some special circumstances, one of which is moving a gun to a new residence. Even though Brian had done nothing illegal, he was sentenced to seven years in prison by a depraved activist judge. Seeing as it is Columbus day, I am reminded of the cautionary tale that can be learned from the treatment of the American Indian for some 400 years.  It is a tale of what happens when one side has the guns and the desire to take and control what the other side has. Chicken Alaska…no, it’s not some savory culinary dish a la chicken alexander but rather a small gold mining town with a population of 17. The members of this town were treated to a rather rude awakening when their little slice of the last frontier was descended upon by a cavalcade of Federal and State agencies.  Or more accurately, the Federal Agencies descended while bringing on some token State agencies in order to make it look less like an invasion and subjugation of state sovereignty. This raid, in which the agencies involved (10) nearly outnumbered the residents of the town (17) is somehow trying to be spun that it was not a raid. Insurance for having to use your gun? Ludicrous…but maybe not ridiculous

The idea that law abiding gun owners would need insurance to cover the costs of legally using their firearms is ludicrous. Unfortunately, that doesn’t mean it is unnecessary. What do I mean?  One need look no further than the George Zimmerman self defense trial.  Zimmerman gets jumped by a gay-bashing homophobe and pummeled into the sidewalk.  He shoots his attacker to save his own life in a clear case of self defense, yet due to political pressure and the complete absconding of fairness is charged with both a crime AND $500,000 (before lawyer fees) in order to defend himself. I wish that were the only case in which a gun owner, acting responsibly in defense of their own life was being railroaded by malicious prosecution due to anti gun sentiment or political pressure, but it’s not. I wanted the weekend to see where things were going to shake out with the whole Zimmerman not-guilty verdict.  As you may know if you are a regular follower of this blog that I believe that Zimmerman acted within the constraints of the law when he shot an aggressor who was trying to murder him. Whether the events that led to that moment were of the best choosing, I withhold judgment one way or the other.  But, I do not believe Zimmerman threw the first punch and I do believe that he had one two choices when he was pinned to the ground, either get beaten to death or shoot. A jury acquitted Zimmerman of all charges despite the best efforts of a Judge who was completely in the tank for the prosecution as well as pressure from DC in the form of the Department of Justice rallying people...

The trial of George Zimmerman has barely begun and one can see the outrageous steps that an overzealous prosecution and complicit judge will go to in order to get a conviction. Before we get to that though, we must start at the beginning.  I still contend that if George Zimmerman went by his mother’s maiden name and was Jorge Mesa that the nation never would have heard this story.  But when you get someone with a white sounding name shooting a black guy, facts and objectivity be damned for the national media.
